Eligibility
You must be at least 16 years old to use the App. If you are using the App on behalf of someone else, you confirm you have the authority to agree to these Terms on their behalf.
Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@dochapp.com if you suspect unauthorized use of your account.
Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Submit content that infringes another person's rights, is abusive, or is otherwise inappropriate for a language-learning tool
- Attempt to disrupt, reverse-engineer, or gain unauthorized access to the App or its backend systems
- Use automated means to scrape or extract content from the App outside of its intended features
We may suspend or terminate accounts that violate this section.
Content You Submit
The App allows you to submit written text (e.g. practice essays) to receive AI-generated feedback, as described in our Privacy Policy.
- Your content remains yours. You retain ownership of any text you submit.
- By submitting content, you grant us a limited license to process it (including sending it to our AI feedback provider, OpenAI) solely to provide the feedback feature and maintain your practice history within the App.
- You are responsible for ensuring you have the right to submit any content you provide, and that it does not violate any third party's rights.
AI-Generated Feedback Disclaimer
Feedback provided by the App is generated using a third-party AI system and is intended as a study aid only. It is:
- Not a substitute for professional language instruction or an official Goethe-Institut assessment
- Not guaranteed to be accurate, complete, or free of errors
- Not an official Goethe-Institut product or endorsed by the Goethe-Institut
You should independently verify important feedback, especially ahead of an actual exam.
Paid Access (“Doch! PRO”)
6.1 What you are buying
Full access to the App is sold as one-time access packages of 30, 60 or 90 days. These are not subscriptions: nothing renews, and you will never be charged again unless you deliberately buy another package.
You may buy a package at any time, including while you already have access. The days you buy are added to the end of the access you already have, rather than replacing it.
When a package's access period ends, your account simply returns to the free feature set. Your account, your practice history and your feedback remain.
Access is tied to the account it was bought on. If you delete your account, any access period still running ends with it: the remaining days are not refunded, cannot be paused, and cannot be transferred to another account, including a new account you create with the same email address or the same Apple ID or Google account. The App warns you about this before deleting an account that still has paid access.
6.2 Price and payment
Prices are shown in the App exactly as the app store reports them for your country, including any tax the store applies.
Payment is taken by the app store you installed the App from — the Apple App Store or Google Play — under that store's own terms. In the EU, and in most other countries, the store is also the seller: your purchase contract is with it rather than with us (see Section 6.3). We never receive, see or store your card, bank or other payment details. The store tells us only that a valid purchase was made, so that we can unlock access.
We may change prices or stop offering a package at any time. A change never affects a package you have already bought: it runs for the full number of days you paid for.
6.3 Delivery and your right of withdrawal
Access is digital content supplied without a physical medium, and it is unlocked immediately after the store confirms your payment.
When you buy a package, your purchase contract is with the store: Apple Distribution International Ltd. for the App Store, Google Commerce Limited for Google Play. If you are a consumer in the EU, you normally have 14 days to withdraw from a distance contract. Digital content supplied at once is the exception: the right ends when supply begins, provided you agreed to immediate supply and acknowledged that you lose the right by doing so (§ 356 (5) BGB, Art. 16(m) of Directive 2011/83/EU, or the equivalent rule where you live). That consent, the confirmation of your order and any withdrawal are handled by the store under its own terms. Supply begins the moment access is unlocked, so that is when the right ends, not at the end of your 30, 60 or 90 days.
6.4 Refunds
Refunds are handled by the store that took the payment, under that store's refund policy — we cannot reverse a charge made by Apple or Google:
- Apple: reportaproblem.apple.com
- Google Play: play.google.com/store/account/orderhistory
Deleting your account is not a ground for a refund: the access you bought remains available until you delete it. See Section 6.1.
If the store declines and you believe you are entitled to a refund, contact us at support@dochapp.com and we will look at it.
6.5 If you paid but access did not arrive
If a payment goes through and access is not unlocked, the App retries automatically the next time you open it. If access is still missing, write to support@dochapp.com with the store's order or transaction number and we will resolve it.
6.6 Statutory rights
Your statutory rights as a consumer regarding digital products (§§ 327 ff. BGB) are not limited by this section.
Intellectual Property
The App, including its design, exercises, and underlying software (but excluding content you submit), is owned by the operator named above and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from the App except as expressly permitted by these Terms.
“Goethe-Institut” and related exam names are the property of their respective owners; use of these names in the App is for descriptive/ educational reference only and does not imply affiliation or endorsement.
Third-Party Services
The App relies on third-party services — an authentication provider, an AI feedback provider, a crash-reporting provider, and the Apple and Google app stores for payment — as described in our Privacy Policy. We are not responsible for outages or issues caused by these third-party services being unavailable.
Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED FEEDBACK WILL BE ACCURATE.
This section does not apply where the law does not allow it, and in particular does not limit the statutory rights described in Section 6.6.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING RELIANCE ON AI-GENERATED FEEDBACK, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Nothing in these Terms limits our liability for death or personal injury caused by negligence, for intent or gross negligence, for the breach of an essential contractual obligation, or under the German Product Liability Act (Produkthaftungsgesetz) — nor any other liability that cannot be limited by law.
Termination
We may suspend or terminate your access to the App at any time for violation of these Terms. You may stop using the App and delete your account at any time, as described in our Privacy Policy.
If we terminate your account or end the service for a reason you did not cause while you have unused paid access, we will restore your access for the remaining period or, where that is not possible, refund the unused portion.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you in the App or by other reasonable means before the changes take effect. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
Governing Law and Dispute Resolution
These Terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.
If you are a consumer with your habitual residence in another EU/EEA country, this choice of law does not deprive you of the protection of the mandatory consumer-protection rules of that country.
We are neither obliged nor willing to take part in dispute-resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle).
